Whistleblower Attorney Says Backlog of Federal Whistleblower Cases is “Devastating”

Stephen M. Kohn, partner at Kohn, Kohn & Colapinto, was featured in the National Law Journal today. The article, “DC Whistleblower Bar Awaits Movement on MSPB,” covered the current backlog of federal whistleblower cases in the Merit Systems Protection Board (MSPB).

Kohn called the backlog “devastating” and noted that retaliation still runs rampant in the federal government and corporate America.

“If it remains, (federal whistleblowers) effectively have no rights,” Kohn said in the article. “I just don’t know how they get out of this.”

The MSPB is designed to be the “guardian of Federal merit systems”, but now the three-member board is vacant for the first time in its 40-year history. The board has now gone without a quorum for two years.

The article highlighted last week’s annual celebration of National Whistleblower Day and the recent passage of the Taxpayer First Act, which provides protections to tax whistleblowers.
