SEC Awards $28 Million to Seven Whistleblowers After Recovering Millions for Harmed Investors

On December 22, the U.S. Securities and Exchange Commission (SEC) announced more than $28 million in whistleblower awards granted to seven individuals who all voluntarily provided the Commission with original information which aided in the success of the same enforcement action. The SEC awarded $13 million to a single whistleblower, $13 million to four joint whistleblowers, and $2 million to two other joint whistleblowers. IRS Whistleblower Receives $15.1 Million Award for Exposing Sophisticated Tax Evasion Scheme

On November 29, whistleblower attorneys Stephen M. Kohn and Dean Zerbe announced that a joint client – who wishes to remain anonymous – received an IRS whistleblower award of $15.1 million. Whistleblowers Can Earn Millions Exposing Medicare Advantage Fraud

Healthcare fraud makes up a sizable majority of False Claims Act (FCA) settlements and judgements. For the 2022 Fiscal Year, the U.S. Department of Justice reported that $1.7 billion of the total $2.2 billion collected under the FCA stemmed from healthcare fraud cases. False Claims Act healthcare cases often involve efforts to defraud federal healthcare programs like Medicare, Medicaid, and TRICARE. A recent massive FCA settlement against Cigna Group highlights a particular healthcare area with potential for large-scale fraud: Medicare Advantage (Medicare Part C). Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
